“The best defense is to never be in court,” said Kristina Vaquera, Principle in the Norfolk office of Jackson Lewis P.C., in the first of a series of seminars in the Human Resources for Business Leaders Series. The Hampton Roads Chamber has proudly partnered with the Hampton Roads Society of Human Resource Management to present this three-part professional series teaching new practices in the field of human resources. Each seminar of this series will be led by local experts.
In today’s workforce, an employee can be dismissed by an employer without any reason or warning as long as the reason is not illegal. That is why it is crucial for employers to become educated and knowledgeable of their federal and state employment laws. In Vaquera’s presentation, “You Have Employees…Now What? The Employment Law Basics You Can’t Afford Not Knowing,” she discussed the employment laws regarding discrimination, religion, harassment, at-will employment and conduct outside the workplace.
“Documentation is key,” Vaquera says. Whether you are speaking to a terminated employee or meeting with an employee to discuss a leave of absence – document it. Have a witness present, keep your meeting short and clear, get a statement and record it. This will aid you in court cases involving wrongful discharges, employment discrimination including poor performance or improper conduct. Solid documentation is critical.
