"Leave issues have always been a hot topic agenda for most employers, especially now, in the midst of COVID (Coronavirus).” Kristina Vaquera, an Attorney with Jackson Lewis states.

 

On December 2nd, the Hampton Roads Chamber and the Hampton Roads Society for Human Resource Management (HRSHRM) hosted a virtual webinar to inform participants of critical changes in today's workforce. Vaquera presented, Do You Know Where Your Employee Is?: How to Manage Chronic Leave Issues in the Workplace.

 

Is accommodation required, what's reasonable, is this really an FMLA event, am I being taken advantage of? These are all questions that employers have been grappling with daily. Vaquera presented real work environment issues and how employers can handle the problems that arise under the FFCRA, ADA, FMLA, and other statutes—making all the difference in protecting their business from exposure to employee claims. 

 

As Vaquera went into depth over the Families First Coronavirus Response Act (FFCRA) that was passed in April of this year, she states, "It (FFCRA) applies to employers that are under 500 employees, but for many employers in Hampton Roads, that is you." She goes on to explain that the federal government passed the FFCRA to help individuals whose’ s children schools or daycares had been shut down due to the pandemic.

 

Some common pitfalls that employers find with their employees are the failure to notify employees of their FMLA rights, Misunderstanding of what qualifies as a serious health condition, failure to train managers on FMLA and ADA. "You want to make sure you continue to manage performance issues. You cannot have inflexible leave policies." Vaquera encourages viewers.
